Terms of Service

Acceptance of terms

By accessing or using the StandbyAlerts website and service (the “Service”), operated by Gaffney Enterprises, LLC, under the StandbyAlerts brand, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The Service

StandbyAlerts helps service businesses fill last-minute appointment openings. Customers join a business’s “StandbyAlerts list” and consent to be notified, by text and/or email, when a matching opening becomes available; the first person to validly claim an opening is offered it. StandbyAlerts provides the notification platform only. We do not provide the underlying services, set appointments, guarantee that any opening will become available or remain available, or become a party to any agreement or transaction between you and a business. Availability, scheduling, pricing, and the appointment itself are solely between you and the business.

Use of the Service

You agree to provide accurate information, to use the Service only for lawful purposes, and not to misuse it, attempt to disrupt its operation, or interfere with others’ use. You are responsible for the contact information and consent choices you submit. Text and email alerts are subject to the consent terms presented at signup; you can opt out at any time (reply STOP to texts, unsubscribe from emails, or use the Manage tools).

For businesses

If you use StandbyAlerts to operate a StandbyAlerts list for your business, you are additionally responsible for using customer information only to fill appointment openings through the Service, for honoring opt-outs, and for complying with applicable laws. Any separate paid engagement is governed by a separate written agreement.

Intellectual property

All content on the Service, including text, graphics, logos, and code, is the property of Gaffney Enterprises, LLC or its licensors and is protected by applicable intellectual property laws.

Third-party links and services

The Service may link to or rely on third-party websites and providers. We are not responsible for the content, policies, or practices of those third parties.

Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the Service’s accuracy, reliability, or availability, or that any appointment opening will be offered, claimed, or honored.

Limitation of liability

To the maximum extent permitted by law, Gaffney Enterprises, LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any missed, unavailable, or disputed appointment.

Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
